  • Within distances from wetlands according to the stricter of state and local regulations.
  • New land located within 50 feet of water intended for fish inhabitation and recreational or industrial purposes, supporting the Clean Water Act. Within 50 ft of lake, sea, river and streams (Clean Water Act) [<50 ft of Waterbody]
  • Previous public parkland, except land accepted in trade by the public landowner. Land which prior to acquisition for the project was public parkland, unless land of equal or greater value as parkland is accepted in trade by the public landowner  (USDA) (Park Authority projects are  exempt)
